Patent strategy for wearables and smart devices

Schell IP helps wearable technology businesses evaluate patent questions in sensors, fit systems, power management, connectivity, and device appearance. We connect the hardware and software contribution with prototyping, user testing, manufacturing, and launch plans.

Look at how the device works on the body

A wearable product may depend on sensor placement, an attachment mechanism, signal processing, or a particular interaction with a phone. Explain how the arrangement addresses movement, contact, power use, comfort, or another technical constraint.

A smart ring, monitoring patch, or training wearable can involve several potential inventions. We can discuss which contributions deserve patent searching and application review, and whether utility and design patent questions should be addressed separately.

Capture changes between prototype and production

User testing and supplier feedback can change the enclosure, electronics, algorithms, or mounting method. Keep a record of those changes and the people responsible. Industrial designers, firmware developers, sensor suppliers, and research partners may bring different rights and obligations.

Health-related claims, data privacy, wireless approvals, and safety testing may require separate review. A patent filing does not establish that the product may make a medical claim or collect particular data. Plan those workstreams alongside the product roadmap.

Prepare a focused invention discussion

  • Identify the sensing, attachment, processing, or power improvement.
  • Describe the prototype, intended use, and meaningful variations.
  • List design, software, supplier, and research contributions.
  • Note user trials, public demonstrations, and production deadlines.

Wearable patent questions

Can the physical design and software be reviewed together?

Yes. Their interaction may be central to the invention, while appearance may present a separate design patent question.

Does combining known sensors create a patentable product?

Not automatically. The arrangement, technical contribution, prior art, and other requirements need assessment.

Should a crowdfunding campaign wait for patent review?

Discuss protection before public disclosure where possible, particularly if international markets matter.
