Patent strategy for mobile apps

Schell IP helps app founders and developers evaluate patent questions about the technical operation of mobile applications. We connect invention review with development contracts, beta testing, app-store releases, and the business model behind the product.

Start with what the app does technically

An app idea, a screen layout, and a computer-implemented invention are different things. A useful patent discussion explains how the application handles a technical problem, such as device coordination, data processing, communication, or interaction with hardware.

Describe the system behind the interface: what happens on the phone, what happens on a server, and which steps create the improvement. Merely automating a familiar business task or adding AI does not establish patent eligibility. Specific claims, prior art, and adequate disclosure require review.

Connect the build plan with ownership

Outside developers, cofounders, designers, open-source components, and platform services can all contribute to an app. Agreements should distinguish ownership of deliverables and inventions from licenses to third-party tools. Paying a developer does not by itself answer every ownership question.

We can discuss invention disclosures, searches, application preparation, and prosecution, alongside relevant contracts with appropriate counsel. Patent protection, source-code copyright, trademarks, and confidentiality address different assets and can be considered together.

Prepare before beta or public launch

  • Explain the technical feature and provide a general system diagram.
  • Identify the app, server, device, and third-party service components.
  • List developers, contributors, and relevant agreements.
  • Flag beta invitations, demos, crowdfunding, and app-store dates.

Mobile app patent questions

Can I patent an app idea?

A broad idea alone is insufficient. The particular invention, implementation, and patent requirements need assessment.

Does copyright in the code replace a patent?

No. Copyright and patent rights protect different subject matter and have different scope.

Should patent review wait until the app is finished?

It can begin earlier. Timing depends on what can be adequately described and what will be disclosed during development or launch.
