Schell IP helps fashion and apparel businesses evaluate patent questions in functional garments, closures, textile structures, accessories, and product appearance. We connect the proposed innovation with sampling, sourcing, collection launches, and the broader intellectual property plan.

A garment can combine an ornamental appearance, a functional construction, and a brand identity. Those features raise different questions. Utility patent review may address a particular technical mechanism; design patent review concerns qualifying ornamental design; trademarks identify commercial source.
A new closure arrangement, convertible structure, or functional textile assembly deserves a different discussion from a seasonal color choice. We can help identify the contribution and discuss searches, drawings, and application priorities without assuming every fashion idea is patentable.
Lookbooks, crowdfunding, runway events, social posts, wholesale presentations, and marketplace listings can disclose a product. Identify launch timing early and review confidentiality and ownership terms with designers, sample makers, factories, and collaborators.
The production version can also differ from the prototype. Record changes to features and appearance before committing to tooling or a large order. A patentability review does not resolve whether another party's patent, trademark, or other rights affect the launch.
Some functional apparel inventions or ornamental product designs may qualify. The particular design or construction and relevant legal requirements determine the analysis.
A trademark and a patent serve different purposes. A coordinated review can identify which rights relate to the actual product.
Discuss protection before public release where possible. Disclosure timing and intended countries can affect available options.
